These Terms of Service ("Terms") govern your access to and use of the D&L Garage Doors website, AI-powered online estimator, and all related services (collectively, the "Services") provided by D&L Garage Doors ("we," "us," or "our"). We operate in Oregon, Idaho, and Washington, with offices at 6701 SE Foster Rd, Suite #D, Portland, OR 97206 and 3800 West Chinden Blvd, Boise, ID 83714. We are licensed as follows: Oregon CCB #194109, Washington LNI #DLGARGD820CF, Idaho RCE #42914. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services. These Terms incorporate by reference our Privacy Policy and AI Disclosure & Transparency Policy. We may update these Terms at any time—continued use constitutes acceptance of changes.

1. Description of Services

We provide garage door repair, spring replacement, installation, openers and accessories, commercial garage doors, and related services. Our online AI-powered estimator offers rough cost approximations based on user inputs, location, and market data. Services are available in select areas of Oregon, Idaho, and Washington, subject to technician availability. Emergency and same-day services may incur additional fees and are not guaranteed.

2. User Eligibility and Obligations

You must be at least 18 years old to use the Services. By using the Services, you represent that you are of legal age and agree to provide accurate information. You agree not to misuse the Services, including submitting false data, interfering with functionality, or using automated tools without permission. You are responsible for maintaining the confidentiality of any account information and for all activities under your account.

3. AI Estimator and Estimates

Our AI estimator provides non-binding, approximate price ranges based on your inputs and general data—it is not a quote, contract, or guarantee. Actual costs may vary due to on-site conditions, materials, labor, or other factors. A diagnostic fee of $89 (plus tax) applies to on-site visits and is credited toward approved repairs. By using the estimator, you acknowledge its limitations and agree not to rely on it for decisions.

4. Appointments and Fees

Appointments are scheduled based on availability. A minimum $89 service call fee applies (waived or credited under certain promotions for first-time customers; cannot be combined with other offers). Emergency, after-hours, weekend, or extended-area services may require a $289 advance fee (plus tax), added to the final invoice. All fees are non-refundable except as specified. We reserve the right to cancel or reschedule due to weather, emergencies, or other uncontrollable events.

5. Payments and Billing

Payment is due upon service completion unless arranged otherwise. We accept cash, checks, major credit cards, and other methods. For custom orders (e.g., new doors), a 50% deposit may be required, non-refundable if canceled after production starts. Prices exclude taxes, permits, or additional fees. Overdue payments accrue interest at 1.5% per month. You authorize us to charge for approved services.

6. Warranties and Guarantees

We provide warranties on parts and labor varying by service: e.g., 60-90 days for basic maintenance, up to lifetime on certain parts per manufacturer. Warranties are void if due to misuse, alterations, or non-D&L repairs. Photo eyes, remotes, batteries, and accessories are not warranted; user responsible for maintenance. Full warranty details provided in writing at service. We disclaim all other warranties, express or implied, including merchantability or fitness for purpose.

7. Cancellations and Refunds

Cancel appointments at least 24 hours in advance to avoid fees. No refunds for deposits on custom orders after processing. Refunds for overpayments processed within 30 days. We may cancel services for non-payment, violations, or safety reasons without liability.

8. Intellectual Property

All content, trademarks, and materials on our site (including AI estimator) are owned by us or licensors. You may not copy, modify, or use them without permission, except for personal, non-commercial use.

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages arising from the Services, including but not limited to losses from estimates, AI errors, delays, property damage, or pre-existing conditions. Our total liability is limited to the amount paid for the specific service. We are not liable for force majeure events (e.g., weather, strikes, pandemics). DIY repairs are dangerous—attempt at your own risk; we disclaim liability.

10. Indemnification

You agree to indemnify and hold us harmless from claims, losses, or damages arising from your use of the Services, violations of these Terms, or third-party claims related to your actions.

11. Termination

We may terminate or suspend your access to the Services at any time for violations, without notice or liability.

12. Governing Law and Dispute Resolution

These Terms are governed by Idaho law (without conflict principles). Disputes shall be resolved through binding arbitration in Boise, ID, under AAA rules, or in small claims court if applicable. You waive class actions and jury trials.

13. Miscellaneous

If any provision is invalid, the rest remain enforceable. No waiver of breaches. These Terms constitute the entire agreement. Headings are for convenience.
